Introduction and definitions

Introduction

Welcome to ClassEka.com (“Platform”, “Service”, “we”, “us”, or “our”). ClassEka.com is an online platform that enables teachers to publish tuition class listings and enables students and other users to search, discover, follow, and interact with such listings within Sri Lanka.

The Platform acts solely as an intermediary technology service that facilitates the publication and discovery of tuition-related information. We do not provide tuition services, do not employ teachers, and do not act as an educational institution. All tuition services are provided independently by third-party teachers and tutors.

By accessing, registering, or using ClassEka.com in any manner, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must not use the Platform.

These Terms apply to all users of the Platform, including but not limited to teachers, students, visitors, and any other individuals who access or interact with the Service.

Definitions

For the purposes of these Terms, the following definitions shall apply:

“Platform” or “ClassEka.com” - Means the website, applications, services, features, and systems operated under the domain ClassEka.com and any related subdomains or services.

“Service” - Means all functionalities provided through the Platform, including but not limited to registration, tuition class listings, search features, rating systems, messaging, email notifications, following classes, and tuition wanted postings.

“User” - Means any individual who accesses or uses the Platform, including Teachers, Students, and visitors.

“Teacher” - Means any User who registers an account and publishes tuition class listings or related educational services on the Platform.

“Student” - Means any User who registers an account for the purpose of searching, following, reviewing, or interacting with tuition class listings or teachers on the Platform.

“Content” - Means any information, text, images, descriptions, listings, reviews, ratings, messages, or other materials submitted, posted, or shared by Users on the Platform.

“Teacher Listing” - Means any tuition class advertisement or profile created and published by a Teacher on the Platform.

“Student Content” - Means any reviews, ratings, recommendations, tuition wanted posts, messages, or other materials submitted by Students or Users.

“User Account” - Means a registered account created by a User to access and use the Platform.

“Following” - Means a feature that allows a Student to subscribe to a Teacher’s or tuition class listing, enabling updates, notifications, and access to related features such as classmate visibility.

“Classmates” - Means Users who are following the same Teacher or Tuition Class Listing through the Platform.

“Tuition Wanted” - Means a feature that allows Users to post requests seeking tuition classes or educational services.

“Ratings” - Means numerical scores provided by Students to Teachers through the Platform.

“Recommendations” - Means written feedback or reviews submitted by Students regarding Teachers or tuition classes.

“Third-Party Services” - Means external services not owned or controlled by ClassEka.com, including but not limited to SMS gateways, email providers, hosting providers, analytics services, and payment processors (if applicable).

SECTION 1: USER ACCOUNTS AND REGISTRATION

Account Creation

In order to access certain features of the Platform, Users are required to register for a User Account. When creating an account, Users agree to provide accurate, current, and complete information as requested during the registration process. Users must ensure that all information provided during registration and throughout the use of the Platform remains accurate and up to date. We reserve the right to suspend or terminate any account where information provided is found to be false, misleading, incomplete, or otherwise in violation of these Terms.

Account Eligibility

To use the Platform: Users must be capable of entering into a legally binding agreement under applicable law. Users under the age of 18 may only use the Platform under the supervision and consent of a parent or legal guardian. Teachers may be required to provide additional information relevant to their professional or tuition activities, but ClassEka.com does not verify, endorse, or certify any qualifications, credentials, or teaching abilities.

Account Security

Users are solely responsible for maintaining the confidentiality and security of their login credentials, including usernames and passwords. Users agree to: Choose strong and secure passwords; Not share account credentials with any third party; Restrict access to their devices where their account is accessible; Immediately notify ClassEka.com of any unauthorized access or suspected breach of their account. ClassEka.com shall not be liable for any loss, damage, or unauthorized activity resulting from a User’s failure to maintain the confidentiality of their account credentials.

User Responsibility for Account Activity

Users are fully responsible for all activities conducted under their User Account, whether or not such activities were authorized by the User. Any actions taken through a User Account will be deemed to have been performed by the account holder.

Account Suspension and Termination

We reserve the right, at our sole discretion, to suspend, restrict, or terminate any User Account at any time, with or without notice, if we believe that: The User has violated these Terms; The User has engaged in fraudulent, abusive, or illegal activity; The User has provided false or misleading information; The User has attempted to compromise the security or integrity of the Platform; The User’s conduct may cause harm to other Users or to the Platform. Upon termination, Users may lose access to their account, content, followers, messages, and any associated data, without liability to ClassEka.com.

Account Verification

We may, but are not obligated to, verify User identities, email addresses, phone numbers, or other account information using SMS, email, or third-party verification services. Verification does not constitute endorsement, approval, or guarantee of any User or their Content.

No Guarantee of Identity

ClassEka.com does not guarantee that any User is who they claim to be. Users are solely responsible for exercising caution and conducting their own judgment when interacting with other Users, including Teachers and Students. We shall not be responsible for any loss, harm, dispute, or damage arising from interactions between Users.

Platform Right to Refuse Service

We reserve the right to refuse registration, suspend access, or remove accounts for any reason, including but not limited to maintaining the safety, integrity, and reliability of the Platform.

SECTION 2: TEACHER LISTINGS AND STUDENT SERVICES

Platform Role and Nature of Service

ClassEka.com provides an online technology platform that enables Teachers to publish tuition class listings and enables Students and other Users to search, view, follow, and interact with such listings. ClassEka.com is not an educational institution, does not provide tuition services, and does not employ, supervise, or control Teachers. All tuition services are independently offered and delivered by Teachers. We do not guarantee, endorse, or verify the quality, accuracy, legality, safety, or suitability of any Teacher, Tuition Class, or related service listed on the Platform.

Teacher Listings

Teachers are solely responsible for all content they publish, including but not limited to: Class descriptions Subject details Fees and payment terms Schedules and locations (online or physical) Qualifications, experience, and certifications Contact information Promotional content and images By publishing a listing, Teachers represent and warrant that all information provided is accurate, lawful, and not misleading. ClassEka.com does not independently verify Teacher Listings and shall not be responsible for any errors, omissions, or misrepresentations contained within such listings. We reserve the right, but not the obligation, to remove or restrict any listing that we believe violates these Terms or may harm Users or the Platform.

Student Use of Listings

Students may use the Platform to: Search and browse Teacher Listings; View Teacher profiles and tuition class details; Follow classes or Teachers; Submit ratings and recommendations; Contact Teachers through available Platform features. Students acknowledge that all reliance on Teacher Listings is at their own risk, and any decision to engage a Teacher or attend a class is made independently by the Student. ClassEka.com is not responsible for any loss, dispute, dissatisfaction, financial loss, or damage arising from interactions between Students and Teachers.

No Guarantee of Results

ClassEka.com makes no representation or guarantee regarding: Student academic performance or outcomes; Teaching quality or effectiveness; Examination results or success rates; Availability or continuity of any class; Accuracy of any Teacher claims. Any educational outcome depends entirely on the Teacher and the Student.

Tuition Wanted Listings

The Platform may allow Users to post tuition-related requirements (“Tuition Wanted”). Users posting such content are solely responsible for its accuracy and legality. ClassEka.com does not guarantee that any suitable Teacher will respond to such requests, nor does it participate in any negotiation, arrangement, or agreement between Users.

Following Classes and My Class Features

The “Following” feature allows Students to subscribe to Teacher Listings and receive updates or notifications. By following a class or Teacher, Students acknowledge that: They may receive communications related to the followed class; Their profile may be visible to other Users depending on Platform features; ClassEka.com does not control how Teachers or other Students may interpret or use visibility features within the Platform. Users are responsible for managing their own privacy settings and participation in such features.

No Agency Relationship

Nothing in these Terms shall be construed to create any partnership, employment, agency, joint venture, or fiduciary relationship between ClassEka.com and any Teacher or Student. Teachers operate independently, and ClassEka.com merely provides a digital platform for listing and discovery.

Right to Modify or Remove Listings

We reserve the right, at our sole discretion, to: Edit, hide, or remove any Teacher Listing or Tuition Wanted post; Restrict visibility of any content; Suspend access to listing features; without prior notice, where necessary to protect the integrity, safety, or operation of the Platform.

SECTION 3: USER CONTENT, RATINGS, RECOMMENDATIONS, AND COMMUNICATIONS

User Content

Users may submit, post, or share content on the Platform, including but not limited to: Teacher Listings Tuition Wanted posts Ratings and Recommendations Messages between Users Profile information Any other text, images, or materials submitted through the Platform All such materials are collectively referred to as “User Content”. Users are solely responsible for their User Content and the consequences of posting or sharing it. By submitting User Content, Users represent and warrant that: They own or have the necessary rights to share such content; The content is accurate and not misleading; The content does not violate any applicable law or third-party rights; The content does not contain defamatory, obscene, abusive, or unlawful material.

Licence to Use User Content

By submitting User Content to ClassEka.com, Users grant ClassEka.com a worldwide, non-exclusive, royalty-free, transferable licence to: Use, host, store, reproduce, modify, and display such content; Distribute and publish such content within the Platform; Use such content for the operation, promotion, and improvement of the Platform. This licence is required solely for the operation and functioning of the Service. Users retain ownership of their original content.

Ratings and Recommendations

The Platform allows Students to provide Ratings and written Recommendations regarding Teachers. Users acknowledge and agree that: Ratings and Recommendations reflect individual opinions of Users and not the views of ClassEka.com; ClassEka.com does not guarantee the accuracy, truthfulness, or reliability of any Rating or Recommendation; Teachers may choose to “authorize” or approve Recommendations before they appear publicly, where such functionality is provided. ClassEka.com reserves the right to: Remove, hide, or refuse to publish any Rating or Recommendation at its sole discretion; Investigate and act on suspected fake, abusive, defamatory, or manipulated reviews; Adjust or recalculate rating scores where necessary to maintain platform integrity. Users must not submit false, misleading, defamatory, or malicious Ratings or Recommendations.

Review Moderation and Disputes

ClassEka.com does not mediate disputes between Users regarding Ratings or Recommendations. However, we may, at our discretion: Investigate complaints; Temporarily hide disputed content; Remove content that violates these Terms or applicable law. Teachers and Students acknowledge that disagreements regarding reviews or ratings must be resolved independently between Users, and ClassEka.com shall not be liable for any outcome of such disputes.

Communications Between Users

The Platform may enable communication features including (but not limited to): Messaging between Teachers and Students; Email notifications from Teachers to Students or followers; Classmate communication features; Platform-generated notifications. Users agree that: Communications must be used solely for legitimate educational and Platform-related purposes; Users must not send spam, unsolicited advertising, phishing messages, or harmful content; Users must not misuse contact information obtained through the Platform for unrelated purposes. ClassEka.com does not monitor all communications between Users and is not responsible for the content of such communications.

Classmate Visibility and Data Use

Where Users can view or contact Classmates (Users following the same class), Users agree that: Such visibility is provided solely for educational and class-related interaction; User information must not be harvested, copied, or used for marketing or unrelated purposes; Any misuse of User data may result in suspension or termination of accounts. ClassEka.com is not responsible for how Users interact with Classmate information once accessed.

Prohibited Communication Activities

Users must not use the Platform to: Harass, abuse, threaten, or defame others; Send unsolicited bulk messages (spam); Impersonate any person or entity; Distribute malware, phishing links, or harmful content; Collect User data without consent; Misuse messaging or email features for commercial solicitation unrelated to tuition services. We reserve the right to restrict communication features for Users who violate these rules.

Monitoring and Enforcement

ClassEka.com may, but is not obligated to, monitor communications and User Content for compliance with these Terms. We reserve the right to remove or restrict access to any content or communication that we believe, in our sole discretion, violates these Terms or may harm Users or the Platform.

SECTION 4: PRIVACY, DATA PROTECTION, AND SECURITY

Privacy Policy

Use of ClassEka.com is also governed by our Privacy Policy, which explains how we collect, use, store, and protect User information. By using the Platform, Users acknowledge and agree to the terms of the Privacy Policy. In the event of any conflict between these Terms and the Privacy Policy, the Privacy Policy shall prevail with respect to personal data handling.

Collection of Information

We may collect and process the following types of information: Information provided during registration (such as name, email address, phone number, and profile details); Teacher Listing information and related content; Ratings, Recommendations, and User-generated content; Communication data between Users through Platform features; Technical data such as IP address, device information, browser type, and usage analytics; Information collected through SMS, email, or third-party verification services. Users agree that such information may be collected and used for the operation, maintenance, and improvement of the Platform.

Use of Information

We may use User information for purposes including: Providing and maintaining the Service; Enabling Teacher Listings and Student interactions; Sending notifications, SMS messages, emails, and updates; Verifying User identity where applicable; Improving Platform functionality and user experience; Preventing fraud, abuse, and unauthorized access; Complying with legal obligations.

Data Security Measures

We implement reasonable administrative, technical, and organizational measures designed to protect User information against unauthorized access, alteration, disclosure, or destruction. However, Users acknowledge and agree that: No system, server, database, or internet-based service can be guaranteed to be completely secure; Transmission of information over the internet carries inherent risks; We do not guarantee that unauthorized third parties will never be able to defeat our security measures or misuse User data. Users provide their information at their own risk.

Limitation of Liability for Security Incidents

To the maximum extent permitted by applicable law, ClassEka.com shall not be liable for any loss, damage, cost, or claim arising from: Unauthorized access to User accounts or data; Cyber-attacks, hacking attempts, malware, ransomware, phishing, or distributed denial-of-service (DDoS) attacks; Data breaches or security incidents affecting the Platform or third-party service providers; Interruption or failure of communications networks or hosting services; Any unauthorized disclosure of information occurring despite reasonable security measures. Users agree that their sole remedy in the event of a security incident is to discontinue use of the Platform and, where applicable, request account closure.

User Responsibilities for Security

Users are responsible for: Maintaining the confidentiality of their login credentials; Using strong and secure passwords; Ensuring secure access to their devices; Logging out of shared or public devices; Promptly notifying us of any suspected unauthorized access or security breach. We are not responsible for any loss or damage resulting from User negligence in maintaining account security.

Third-Party Services

The Platform may rely on third-party services, including but not limited to: SMS gateway providers; Email delivery services; Hosting and cloud infrastructure providers; Analytics and monitoring tools; Verification and authentication services. We are not responsible for the security, availability, or performance of third-party services, and Users acknowledge that their data may be processed by such providers as necessary for the operation of the Platform.

Data Retention

We retain User data for as long as necessary to: Provide the Service; Comply with legal obligations; Resolve disputes; Enforce these Terms; Maintain security, backup, and audit logs. We may retain certain information even after account termination where required for legal, security, or operational purposes.

No Absolute Security Guarantee

While we strive to protect User information, ClassEka.com does not warrant or guarantee that the Platform will be free from security vulnerabilities, unauthorized access, or other security-related incidents. Users acknowledge that use of online platforms inherently involves risk, and agree that they use the Platform at their own discretion and risk.

SECTION 5: INTELLECTUAL PROPERTY

Ownership of the Platform

All rights, title, and interest in and to the ClassEka.com Platform, including but not limited to the website design, software, code, databases, structure, user interface, features, branding, logos, trademarks, and all related intellectual property rights, are owned by or licensed to ClassEka.com. Nothing in these Terms grants Users any rights to the Platform except the limited right to use the Service in accordance with these Terms.

Limited Licence to Users

Subject to compliance with these Terms, ClassEka.com grants Users a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for personal and non-commercial purposes related to tuition discovery, teaching, and learning. Users must not: Copy, modify, distribute, sell, or lease any part of the Platform; Reverse engineer, decompile, or attempt to extract the source code of the Platform; Use automated systems (including bots, scrapers, or crawlers) to access the Platform without written permission; Reproduce or duplicate the Platform’s structure, features, or design without authorization.

Trademarks and Branding

The name “ClassEka.com”, associated logos, branding, and any related marks are the exclusive property of ClassEka.com. Users may not use, reproduce, or display any branding, logos, or trademarks without prior written consent, except where necessary for legitimate use of the Platform.

User Content Ownership

Users retain ownership of the content they submit or upload to the Platform, including Teacher Listings, Tuition Wanted posts, Ratings, Recommendations, and other User Content. However, by submitting content to the Platform, Users grant ClassEka.com a worldwide, perpetual, non-exclusive, royalty-free licence to: Host, store, and reproduce such content; Display and distribute such content within the Platform; Modify or format such content as necessary for display and technical compatibility; Use such content for operating, promoting, and improving the Platform. This licence continues even after the User stops using the Platform or deletes their account, to the extent necessary for backup, legal compliance, or Platform integrity.

Prohibition on Scraping and Data Extraction

Users and third parties are strictly prohibited from: Scraping, harvesting, or extracting data from the Platform using automated tools; Collecting Teacher or Student information for commercial purposes without consent; Replicating or republishing Platform data in any external system, directory, or website; Creating derivative databases using information obtained from the Platform. We reserve the right to block access and take legal or technical action against any unauthorized data extraction or scraping activities.

Feedback and Suggestions

If Users provide suggestions, ideas, improvements, or feedback regarding the Platform, such feedback may be used by ClassEka.com without restriction or compensation. Users acknowledge that: Feedback is provided voluntarily; ClassEka.com may implement or ignore feedback at its sole discretion; Users waive any rights to claim compensation or ownership over implemented suggestions.

Reservation of Rights

All rights not expressly granted to Users in these Terms are reserved by ClassEka.com. No implied licences or rights are granted under these Terms.

SECTION 6: PROHIBITED USES

General Prohibition

Users agree not to use ClassEka.com or any of its features for any unlawful, abusive, harmful, or unauthorized purpose. Users must comply with all applicable laws and regulations when using the Platform. We reserve the right to suspend or terminate any User Account that violates this Section, with or without notice.

Enforcement Actions

We reserve the right, at our sole discretion, to take any of the following actions in response to a violation of this Section: Issue warnings; Remove or restrict content; Suspend or terminate User Accounts; Block access to the Platform; Report activities to relevant authorities where necessary; Take legal action to protect the Platform and its Users.

No Liability for Enforcement Actions

ClassEka.com shall not be liable for any loss, damage, or inconvenience resulting from actions taken in good faith to enforce this Section, including suspension or termination of accounts or removal of content.

Reporting Violations

Users are encouraged to report suspected violations of these Terms. We may investigate such reports and take appropriate action at our discretion, but we are not obligated to act on every report received.

SECTION 7: DISCLAIMER OF WARRANTIES

“As Is” and “As Available” Basis

The ClassEka.com Platform and all Services are provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied. To the fullest extent permitted by law, ClassEka.com disclaims all warranties, representations, and conditions of any kind, including but not limited to: Fitness for a particular purpose; Merchantability; Accuracy, reliability, or completeness of any content; Non-infringement; Continuous, uninterrupted, or error-free operation of the Platform.

No Guarantee of Service Availability

We do not warrant or guarantee that: The Platform will be available at all times or without interruption; The Platform will be secure, timely, or free from errors; Any defects or issues will be corrected; The Platform will be free from viruses, malware, or harmful components. Access to the Platform may be temporarily or permanently suspended without notice for maintenance, upgrades, technical issues, or reasons beyond our control.

No Educational or Professional Guarantees

ClassEka.com does not provide educational services and makes no warranties or guarantees regarding: The quality of teaching provided by any Teacher; Student academic performance or results; Examination outcomes or success rates; Accuracy of Teacher qualifications, experience, or claims; Suitability of any class or tutor for a Student’s needs. Any reliance placed by Users on Teacher Listings, Ratings, Recommendations, or other User Content is strictly at their own risk.

No Verification of Users

We do not guarantee the identity, background, qualifications, or legitimacy of any User, including Teachers and Students. Users acknowledge that interactions on the Platform occur between independent third parties, and ClassEka.com does not verify or endorse any User.

Third-Party Content and Services

The Platform may contain links to or rely on third-party services, including but not limited to: SMS and email providers; Hosting and cloud services; External websites or resources; Payment processors (if applicable). We do not warrant or assume responsibility for the accuracy, reliability, or performance of any third-party services or content.

User Responsibility

Users acknowledge and agree that: They use the Platform at their own discretion and risk; They are responsible for evaluating and verifying any information before relying on it; Any decisions made based on Platform content are solely their own responsibility.

No Implied Warranties

No advice or information, whether oral or written, obtained from ClassEka.com or through the Platform shall create any warranty not expressly stated in these Terms.

SECTION 8: LIMITATION OF LIABILITY

General Limitation

To the maximum extent permitted by applicable law, ClassEka.com, including its owners, directors, employees, contractors, and affiliates, shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to the use of, or inability to use, the Platform or Services. This includes, without limitation, damages for: Loss of profits, revenue, or business opportunities; Loss of data or corruption of data; Loss of goodwill or reputation; Cost of procurement of substitute services; Any other intangible losses.

No Liability for User Interactions

ClassEka.com shall not be responsible or liable for any disputes, disagreements, or interactions between Users, including but not limited to: Teacher and Student relationships; Accuracy of Teacher Listings; Quality or outcome of tuition services; Payments, agreements, or arrangements made between Users; Misrepresentation or fraud by any User. All interactions between Users are solely at their own risk.

No Liability for Content

We do not accept liability for any User Content, including but not limited to: Teacher Listings; Ratings and Recommendations; Tuition Wanted posts; Messages or communications between Users; Any other content posted or shared by Users. Users are solely responsible for the content they submit, and any reliance on such content is at their own risk.

Security and Cyber Incidents

To the fullest extent permitted by law, ClassEka.com shall not be liable for any loss or damage arising from: Unauthorized access to User accounts or data; Cyber-attacks, hacking attempts, malware, ransomware, phishing, or denial-of-service attacks; Data breaches or security incidents affecting the Platform or third-party providers; Failures of internet connectivity, hosting services, or telecommunications infrastructure. Users acknowledge that no online system is completely secure.

Third-Party Services

We shall not be liable for any damages arising from the use of third-party services integrated with or used by the Platform, including SMS providers, email services, analytics tools, or hosting providers.

Maximum Liability Cap

To the extent that liability cannot be fully excluded under applicable law, the total aggregate liability of ClassEka.com for any claim arising out of or relating to the Platform shall be limited to the amount (if any) paid by the User to ClassEka.com for the use of the Service during the twelve (12) months preceding the event giving rise to the claim. If no payment has been made, ClassEka.com’s liability shall be limited to the minimum extent permitted by applicable law.

Basis of the Bargain

Users acknowledge and agree that: The Platform is provided free of charge or at minimal cost; These limitations of liability are a fundamental basis of the agreement between Users and ClassEka.com; Without such limitations, the Platform would not be provided on the same terms.

Jurisdictional Limitations

Some jurisdictions do not allow certain limitations of liability. In such cases, the above limitations shall apply to the maximum extent permitted by applicable law.

SECTION 9: INDEMNIFICATION

User Indemnification Obligation

Users agree to defend, indemnify, and hold harmless ClassEka.com, including its owners, directors, employees, contractors, affiliates, and agents, from and against any and all claims, demands, actions, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to: Their use or misuse of the Platform; Their violation of these Terms; Their violation of any applicable law or regulation; Any content they submit, post, or share on the Platform; Any Teacher Listing, Tuition Wanted post, Rating, Recommendation, or communication made by them; Any dispute or disagreement between Users, including Teachers and Students.

Content Responsibility

Users acknowledge that they are solely responsible for all User Content they provide on the Platform. Any claim arising from User Content, including allegations of defamation, infringement, misinformation, or unlawful content, shall be the sole responsibility of the User who submitted such content. Users agree to indemnify ClassEka.com against any claims arising from such content.

Teacher-Specific Indemnification

Teachers additionally agree to indemnify and hold harmless ClassEka.com from any claims, disputes, or damages arising from: Accuracy or inaccuracy of Teacher Listings; Claims made regarding qualifications, experience, or services; Student dissatisfaction or disputes regarding tuition services; Any legal issues arising from the provision of tuition services.

Student and User Conduct

Students and general Users agree to indemnify ClassEka.com against any claims arising from: Misuse of communication features; Unauthorized collection or use of other Users’ information; Posting false or defamatory Ratings or Recommendations; Any conduct that violates these Terms or applicable laws.

Defence and Cooperation

Users agree that, upon request, they will fully cooperate with ClassEka.com in the defense of any claim subject to indemnification under this Section. ClassEka.com reserves the right to assume exclusive defense and control of any matter subject to indemnification, in which case Users agree to cooperate fully and not settle any matter without prior written consent from ClassEka.com.

Survival

This indemnification obligation shall survive termination or suspension of a User’s account and continued use of the Platform.

SECTION 10: SUSPENSION AND TERMINATION

Right to Suspend or Terminate

We reserve the right, at our sole discretion, to suspend, restrict, or permanently terminate any User Account, access to the Platform, or any part of the Service at any time, with or without notice, for any reason, including but not limited to: Violation of these Terms; Suspected fraudulent, abusive, or illegal activity; Provision of false, misleading, or incomplete information; Misuse of Platform features, including messaging, ratings, or listings; Security risks or attempts to compromise the Platform; Complaints received from other Users or third parties; Any behavior that may harm the integrity, reputation, or operation of the Platform.

Effect of Suspension or Termination

Upon suspension or termination of a User Account: The User may lose access to their account and associated features; Teacher Listings, Tuition Wanted posts, Ratings, Recommendations, messages, and other User Content may be removed or made inaccessible; The User may be prohibited from re-registering or accessing the Platform in the future. We shall not be liable for any loss or damage arising from suspension or termination of access to the Platform.

No Obligation to Provide Notice

Where appropriate, we may suspend or terminate access without prior notice, particularly in cases involving: Security threats or suspected compromise; Illegal activity; Fraudulent behavior; Immediate risk to Users or the Platform. In other cases, we may provide notice at our discretion, but are not obligated to do so.

User Termination of Account

Users may terminate their own account at any time by discontinuing use of the Platform or by requesting account deletion through available support channels. Termination by the User does not affect any rights or obligations that accrued prior to termination.

Data After Termination

Following termination or deactivation of an account, we may retain certain information where necessary for: Legal compliance; Dispute resolution; Fraud prevention and security purposes; System backups and archival purposes; Enforcement of these Terms. Such retained data will be handled in accordance with our Privacy Policy.

Survival of Obligations

Any provisions of these Terms that by their nature should survive termination (including but not limited to indemnification, limitation of liability, intellectual property, and dispute resolution clauses) shall continue to apply after termination of access.

SECTION 11: GOVERNING LAW AND DISPUTE RESOLUTION

Governing Law

These Terms and any dispute, claim, or obligation arising out of or in connection with the use of ClassEka.com shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka, without regard to its conflict of law principles. Users agree that their use of the Platform is subject to applicable Sri Lankan laws and regulations.

Jurisdiction

Subject to the dispute resolution provisions set out below, the courts of Sri Lanka shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms, the Platform, or the use of the Services. Users consent to the jurisdiction of such courts and waive any objections based on venue or inconvenient forum, to the extent permitted by law.

Informal Resolution

Before initiating any formal legal proceedings, Users agree to first attempt to resolve any dispute informally by contacting ClassEka.com through the official contact channels. We encourage Users to provide a clear description of the issue and allow a reasonable period for response and resolution.

Good Faith Negotiation

If a dispute cannot be resolved informally, both parties agree to attempt in good faith to resolve the dispute through negotiation for a reasonable period before pursuing formal legal action.

No Class Actions

To the fullest extent permitted by law, Users agree that any dispute shall be brought on an individual basis only and not as part of any class, collective, or representative action.

Injunctive Relief

Notwithstanding the above, ClassEka.com reserves the right to seek immediate injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property, Platform security, User data, or to prevent unauthorized use or harm.

Severability of Dispute Provisions

If any provision of this Section is found to be unenforceable, the remaining provisions shall continue in full force and effect.

SECTION 12: MISCELLANEOUS PROVISIONS AND CONTACT INFORMATION

Entire Agreement

These Terms, together with the Privacy Policy and any other policies or legal notices published on ClassEka.com, constitute the entire agreement between Users and ClassEka.com regarding the use of the Platform and supersede any prior agreements, communications, or understandings, whether written or oral.

Amendments to Terms

We reserve the right to modify, update, or replace any part of these Terms at any time at our sole discretion. Where changes are made, we may notify Users through the Platform or other reasonable means. Continued use of the Platform after such changes constitutes acceptance of the updated Terms. It is the responsibility of Users to review these Terms periodically.

Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from these Terms. The remaining provisions shall continue in full force and effect.

Waiver

Failure by ClassEka.com to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing to be valid.

Assignment

Users may not assign, transfer, or delegate their rights or obligations under these Terms without prior written consent from ClassEka.com. We may assign or transfer our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, sale of assets, or reorganization.

Force Majeure

ClassEka.com shall not be liable for any failure or delay in performance resulting from events beyond our reasonable control, including but not limited to: Natural disasters; War, civil unrest, or terrorism; Government actions or restrictions; Internet or telecommunications failures; Power outages; Cyber-attacks, hacking, or security incidents; Failures of third-party service providers.

Relationship of Parties

Nothing in these Terms shall be construed to create any partnership, joint venture, employment, or agency relationship between Users and ClassEka.com. Users acknowledge that they are independent parties using a technology platform.

No Third-Party Beneficiaries

These Terms do not create any rights or benefits enforceable by any person or entity other than the parties to these Terms.
